Startup World supplies 2 types of trust deeds, each with relevant supporting documentation.

All trust deed templates have been prepared on behalf of Startup World and are periodically reviewed by Startup World’s specialist.

Discretionary Trust (Family Trust) Deed

This is a common form of trust, often used in tax and asset protection planning. The trustee uses their discretion to distribute trust income and assets to some or all beneficiaries named in the deed. Typically, the trust lists a small number of people as the nominated (or primary) beneficiaries, and then a wide class of people including the nominated beneficiaries’ distant relatives, as the general (or secondary) beneficiaries.

Unit Trust Deed

Unit trusts are established as an alternative to a company structure, if appropriate to your situation. Managed by a trustee, capital and income of a unit trust are owned by the unit holders in proportion to the number of units held.

How long does it take?

Startup World will deliver all necessary trust documents to your nominated email address usually within 1-2 hours of receiving your order (during business hours). We also offer a deluxe printing service where printed documents will be sent to you using Australia Post’s parcel service. Service standards can be found here.

Duty Stamping Service

If your trust deed has been executed in NSW or Victoria you are required to pay stamp duty upon execution of your trust deed.

Startup World is an official registered agent for the NSW Office of State Revenue (OSR) and the Victorian State Revenue Office (SRO) and can stamp your trust deeds for you saving you time and effort. 

Stamp duty on establishing trust deeds in NSW is fixed by the OSR, as long as they are stamped within 3 months of the date of execution. The cost is $500 plus $10 for every duplicate trust deed. For example, if you would like all four copies of your trust deed stamped, the total cost of the stamp duty is $530.

Stamp duty on establishing trust deeds in Victoria is fixed by the SRO, as long as they are stamped within 30 days of the date of execution. The cost is a flat rate of $200.

For NSW, simply send your signed trust deeds and a completed declaration of execution to us and we will stamp your deeds and send them back to you within 2 business days.

For Victoria, please scan and email to us your signed trust deed and a completed declaration of execution and we will lodge the Deed with SRO. Please be advised the Victorian SRO will not issue a certificate of duty until payment has been cleared which can take a further 3-5 business days.
